Frequently
Asked Questions About AI and the Law

Quick answers to common questions about copyright, voice and likeness rights, and contracts involving artificial intelligence.

Possibly, in part. U.S. copyright protects human authorship, so purely AI-generated material cannot be registered. Your own lyrics, melodies, edits and creative selection or arrangement of AI output may be protected. We help you document your contributions and prepare an application that correctly identifies what is human-authored.

It depends. Courts are still deciding when AI training is fair use, and the answer can turn on how works were obtained and how outputs compete with the originals. Contracts and platform terms also matter. We can review your agreements, help you use available opt-outs and negotiate paid licenses with AI companies.

Act quickly. Preserve evidence, then we can send takedown requests to platforms, send cease-and-desist letters and evaluate right of publicity, false endorsement, copyright or defamation claims. Depending on where the content was created or used, state laws such as Florida’s and New York’s publicity statutes or Tennessee’s ELVIS Act may apply.

Not as of September 2026. The NO FAKES Act of 2026, which would create a federal right to control digital replicas of a person’s voice and visual likeness, was approved by the Senate Judiciary Committee in June 2026 and still needs votes in both chambers. Until then, state laws and contracts provide the main protection.

Only with clear limits. A good agreement should describe exactly how the replica will be used, for how long, in which media, how you will be paid and approve uses, and what happens when the deal ends. New York law restricts certain vague digital replica provisions. We negotiate these terms before you sign.

Generally, yes. The U.S. Copyright Office asks applicants to identify and exclude AI-generated content that is more than minimal and to describe the human-authored contribution. Getting this wrong can put a registration at risk. We help you prepare accurate applications for music, visual art, books and audiovisual works.

It depends on the tool’s terms of service and on how much human authorship the work contains. Some platforms assign outputs to users, others keep broad licenses or restrict commercial use. We review the terms of the tools you rely on and help structure agreements so ownership is clear for you, your collaborators and your clients.

Yes, but with care. New York now requires conspicuous disclosure when ads use AI “synthetic performers,” and FTC rules on deceptive endorsements still apply. Using a real person’s recognizable voice or likeness without consent can also create publicity claims. We help brands and agencies build compliant AI campaigns.

Most AI startups need a sound entity structure, founder and contractor IP assignments, terms of service, a privacy policy, data and content licenses for training materials, and trademark clearance for the product name. We help founders put these pieces in place so the company is ready for users, partners and investors.

It depends on the scope of your matter. ChaseLawyers® offers a free consultation, flat-fee packages for common services such as contract reviews and registrations, and hourly or retainer arrangements for ongoing work or disputes. We will explain your options clearly before any work begins.

AI can be a powerful creative partner – as long as your rights come first. Book a free consultation with ChaseLawyers® today, and we will help you protect your work, your voice and your ideas in the age of generative AI.
